Antitrust

  • Diamonds Antitrust Litigation
    Class action lawsuit brought on behalf of purchasers of diamonds and diamond jewelry in the United States against the De Beers group of companies 
  • Microsoft Antitrust Litigation
    Indirect purchaser antitrust class actions in California, Minnesota, Iowa and Wisconsin alleging that Microsoft has illegally maintained a monopoly in the market for personal computer operating system, word processing and spreadsheet software. 
  • Chinese Vitamin C Antitrust Litigation
    This is the first antitrust case in the U.S. against Chinese manufacturers. The plaintiffs allege that Chinese pharmaceutical companies conspired to fix prices and control export output of Vitamin C. Zelle Hofmann is defending one of the largest pharmaceutical companies in China and its affiliates. 
  • Linerboard Antitrust Litigation
    Zelle Hofmann represents three large purchasers of corrugated containers and related products in a case alleging that the defendant manufacturers conspired to restrict output at their linerboard mills for the purpose of raising prices of corrugated containers. Settlements have resulted in significant recoveries. 
  • Vitamins Antitrust Litigation
    Vitamin manufacturers in the 1990s participated in what was probably the largest global cartel in history, eventually resulting in guilty pleas and the payment of large fines in the United States, the European Union and elsewhere. Zelle Hofmann represented a large vitamin purchaser in the civil litigation that followed and achieved a significant recovery for the client. 
  • United Kingdom Cartonboard Antitrust Litigation
    A private antitrust action in the United Kingdom on behalf of an international food manufacturer alleging price fixing by suppliers of packaging materials.

    $3.6 million jury verdict in products liability case 
  • Motor Fuel Temperature Sales Practices Litigation
    Zelle Hofmann is defending a major integrated oil company in a case involving claimed violations of consumer protection statutes and various common law claims under the laws of 25 states. The core allegation is that it is deceptive to sell motor fuel at retail in uniform volumetric gallons without adjusting for the effect of temperature on the energy content of the fuel. 

Construction Litigation

  • World Trade Center 9/11 Insurance Claims
    Zelle Hofmann is lead counsel for all 9/11 claims for one of the world's largest insurance companies. In this role, Zelle Hofmann was one of the lead counsel in all aspects of the multi-billion dollar property and business interruption insurance claims made by the World Trade Center's owners, Silverstein Properties and the Port Authority of New York and New Jersey. In the Silverstein matter, Zelle Hofmann's representation included a two-month jury trial, appeals and a multi-year contested appraisal of the value of the insured loss. The Silverstein matter was resolved in mid-2007 after intensive settlement negotiations involving New York Governor Elliot Spitzer and New York's Insurance Superintendent. Zelle Hofmann's involvement continues with respect to the Port Authority's 9/11 World Trade Center claim. In addition, with Zelle Hofmann's assistance, numerous other 9/11 claims have been successfully resolved out of court, while others have been litigated or resolved through contested appraisal proceedings. 

Energy/ Oil & Gas Litigation

  • Motor Fuel Temperature Sales Practices Litigation

Insurance Coverage

  • Commonwealth Insurance Co. et al. v. Stone Container Corp., (N.D. Ill.)
    The court’s ruling in favor of IRI was affirmed by the Seventh Circuit. See Commonwealth Ins. Co. v. Stone Container Corp., 351 F.3d 774 (7th Cir. 2004). Complex insurance coverage proceeding involving a claim for $28.4 million plus interest for a loss sustained as a result of a rupture/explosion of a pressure vessel. 
  • Hurricane Katrina Insurance Coverage Litigation
    Zelle Hofmann has been retained by several of the largest property insurance carriers in the world to provide legal advice in connection with losses arising out of Hurricane Katrina. Many of those losses involve several hundred million dollars in dispute. 
  • Mosaic Global Holdings, Inc. v. Employers Insurance Company of Wausau (Illinois)
    Victory for insurer in environmental insurance coverage case involving $11 million claim. 
  • MS BAIT v. Employers Insurance of Wausau
    Complex insurance coverage proceeding involving a $14 million coverage claim for loss sustained as a result of fire. 
  • The Raymond Group Inc. v. St. Paul Fire & Marine Insurance Company
    Victory obtained on behalf of insurer staying action in federal court and requiring insured to arbitrate claims.

    Trademark infringement and dilution action alleging that Exxon's use of its Cartoon Tiger infringed and diluted Kellogg's TONY THE TIGER character.
